Kyla Lee Discusses Roadside Rights and Road Safety on Ship of Fools
Kyla Lee joined Steven Melovich on the Ship of Fools podcast for a conversation about impaired driving law, roadside investigations and the challenges created by e-bikes, e-scooters and other emerging transportation technology.
Kyla explained what drivers are required to do during a traffic stop and what information they are not legally obligated to provide. While drivers must identify themselves and comply with a valid breath demand, they generally do not have to answer questions about where they are coming from, where they are going or whether they have consumed alcohol.
As Kyla put it:
“The biggest power move you have when you’re pulled over by the police is silence.”
She explained that answering unnecessary questions can sometimes give police additional grounds to continue an investigation.
The discussion also covered cannabis and prescription drug impairment, Immediate Roadside Prohibitions and the complicated laws surrounding e-bikes and e-scooters. Kyla noted that transportation technology is often advancing faster than legislation can respond, creating confusion around licensing, insurance and enforcement.
Kyla also spoke about why public legal education remains central to her work:
“Empowering people with knowledge about what their rights are, what their obligations are is the best way to prevent people from finding themselves on the wrong side of the courtroom.”
