You have received a violation ticket and are preparing for the hearing. As a disputant, you are entitled to know the evidence that the issuing officer is going to rely on to prove that you committed the offence that you were issued a ticket for.
Can you get that evidence before the hearing date?
The answer is yes. You can request the disclosure for your violation ticket from the issuing officer or detachment. The best way to do so is to contact the detachment for which the issuing officer works for and find out how to make the request. Requests need to be made in writing, whether that be by fax, mail, or email. Each detachment has their own way of requesting and providing disclosure for traffic tickets and it is best to contact the detachment to find out their policy.
When requesting disclosure, you want to make it clear what you are requesting. You may want to request the notes of the officer, the violation ticket itself if you no longer have it, any audio or video of the incident or traffic stop, any witness statements, or any photographs. You are entitled to all disclosure in which you believe you need in order to make full answer and defence to the violation ticket in which you were issued.
