Many drivers in British Columbia are surprised to learn that you can, in fact, receive a speeding ticket without ever being pulled over by a police officer. This can happen through the use of automated enforcement methods, such as speed cameras, which are increasingly common across the province.
How Speed Cameras Work in BC
Speed cameras are typically installed at intersections known for high rates of speeding or collisions. These cameras use radar or laser technology to detect vehicles traveling above the speed limit. When a vehicle is detected speeding, the camera takes a photograph of the vehicle’s licence plate. The registered owner of the vehicle then receives a ticket in the mail, regardless of who was actually driving at the time of the offence.
No Driver Penalty Points, But Fines Still Apply
Unlike traditional speeding tickets issued by police officers, speed camera tickets do not result in driver penalty points on your record. However, the fine must still be paid by the registered owner of the vehicle, and unpaid tickets can affect your ability to renew your vehicle insurance or registration. These tickets are considered owner liability offences, which means the responsibility falls on the owner, not necessarily the driver.
It’s also possible to receive a ticket by mail if a police officer observes your vehicle speeding and records your licence plate number, even if they do not stop you at the time. In these cases, the officer may later issue a ticket to the registered owner, who then has the opportunity to dispute the ticket if they were not the driver.
Similarly, a civilian complaint about your driving may also trigger a ticket being issued to you either by mail or by having an officer attend at your residence and hand it to you personally.
What to Do If You Receive a Ticket by Mail
If you receive a speeding ticket in the mail and believe it was issued in error, or if you were not the person driving at the time, you have the right to dispute the ticket. The process can be complex, and it’s important to respond within the time frame indicated on the notice.
