For Zahra Rasul and Josh Jankovics, a proposal to crack down on reckless drivers called Xavier’s Law isn’t just about their son.
“We’re just trying to … even if it’s one more person in the future, to help save someone’s life,” Jankovics said.
The Vancouver Island family was at the Legislature Monday as MLAs debated the private member’s bill, named after 12-year-old Xavier Rasul-Jankovics.
But Kyla Lee, a Vancouver-based defence lawyer who specializes in drunk driving, says the proposed law raises red flags.
She said the lack of appeal options allows police officers to be “judge, jury and executioner.”
“There is no ability to challenge the officer’s exercise of authority in imposing an automatic licence suspension at the roadside,” she said.
“The prohibitions are entirely based on an officer’s discretion and interpretation of what they see.”
