What Does The Prosecution Have to Prove in a Hit and Run Case?

Being involved in a car accident is a panic-inducing experience. In startling situations, your judgment is impaired and you might be tempted to get away as quickly as possible. If you fail to stop at the scene of an accident, however, you may be committing a criminal offence. A hit and run, or failure to stop at the scene of an accident to give its proper name, is an offence under the Criminal Code. The punishment can be up to five years in jail or even longer if the accident results in bodily harm. If the accident results in death, you could be sentenced to life in prison.

A recent ruling from the Court of Appeal of Yukon serves as an example of what the Crown must do in order to prove the offence in Court.
