Deanna Passera was convicted of a criminal offence. After her conviction, but before she was sentenced, she spent some time in jail, beginning to serve her sentence.
Unfortunately, a question arose to whether or not that time before she was sentenced and after she was convicted, counted towards her period before she was eligible for early release.
The court had to consider in her case whether or not the combined effect of certain provisions of the Criminal Code and certain provisions of the Charter ultimately prevented her from getting an earlier release because she had started serving her sentence before she was actually sentenced.
