Ontario Superior Court Justice Maria Carroccia says she didn’t find the complainant’s evidence to be “credible or reliable,” and the Crown failed to prove she didn’t consent to the sexual activity.
“Given the number of inconsistencies which were ultimately identified by the trial judge in the testimony, the way that things were testified about were proven by video, it did impact upon the complainant’s credibility in a way that would lead a trier of fact to have a reasonable doubt…”
