Some courts have the power to strike down laws, while others do not. And if certain charges can only be dealt with in certain courts, then remedies for unconstitutional laws may be out of the grasp of accused individuals. Is this fair? I think not, and the Supreme Court of Canada could have had an opportunity to correct the issue.
